The holder of a trademark can renew the same indefinitely every ten years. The 'Registrar' gives six months before the end of ten for trademark renewal. In the case of a person failing to renew a trademark, the 'Registrar' will issue an advertisement in the Trademark Journal, indicating the removal of the trademark. After completion of ten years, trademark renewal will draw a fine.

Need for renewal of Trademark:

There are many advantages to renewing a trademark.

  1. Trademark registration confers on the trademark owner numerous rights protected by law.
  2. It prevents the infringement of the trademark and also provides for restitution in case of such infringements.
  3. It also allows the holder the right to transfer the trademark to another person or company at their will.
  4. Licensing of trademarks is only possible for a registered trademark.

How to apply?

  1. You need to file a prescribed form [TM-12], which is an application for renewal before the 'Registrar'.
  2. This application needs to be filed on or before 6 months from the date of the expiration of the registration.
  3. Three months before expiration and non -renewal, 'Registrar' shall send a notice to the proprietor informing him of the upcoming renewal date.
  4. Along with the renewal request, the owner must pay the renewal fee as prescribed. Failure to pay these fees will result in the removal of the trademark from the register.

Consequences of failure to a renewal of 'Trademark'

  1. The 'Registrar' may remove the mark from the register.
  2. Non-renewal affects not only the owner but also all persons to whom the mark is assigned or authorized. It also affects your legal rights
  3. A registered trademark has the advantage of exclusivity & it discourages other people from using your brand.

Still, the Trademark Act provides another chance to renew the mark within 6 months of the expiration date of registration by a prescribed filing form [TM-10] and by paying the surcharge.

Restoration of Trademark

Post expiration, the owner may request restoration of the mark within 6 months to 1 year after the date of the expiration of such registration. The proprietor has to file a prescribed form [TM-13] to request restoration.

After receiving trademark renewal or restoration requests, the Registrar will advertise the trademark again and invite those who have reason to believe that the trademark should not be renewed or restored.

After the expiration of the prescribed waiting period, if no objection is raised, the mark will be entered in the register of marks. The entry shall specify that the mark has been renewed for 10 years.
