The Berne Convention of 1886 for the Protection of Literary and Artistic Works is the oldest international agreement dealing with copyright. Under the legal system, registration gives its owner exclusive and individual rights to distribute, reproduce, reproduce the work, or give permission to another entity for the same thing. It offers a set of rights - communication to the public, rights of reproduction, adaptation, and translation of the work.

However, ideas, procedures, methods of operation, or mathematical concepts cannot be protected by copyright.

What can be covered under copyright?

Copyright does not exist for every type of work. It is possible to protect a work by copyright only if it is an original:

  1. Artistic work such as a logo or painting.
  2. Literary work such as a book or computer program.
  3. Dramatic Work such as a play.
  4. Musical work such as graphic.
  5. Cinematographic work such as a video or movie.
  6. Sound Recording such as a song.

How to apply?

  1. A copyright registration application needs to be filed in the concerned forms with the Copyright Registrar. The application will mention the particular details and nature of the work.
  2. Application forms must be duly signed by the applicant and the application must be submitted by an Advocate under whose name Power of Attorney has been executed.
  3. Once the application is submitted online, a Diary number is issued.
  4. There is a waiting period of 30 days within which the Copyright Examiner will review the application for potential discrepancies and/or objections.
  5. If discrepancy and/or objections are found, discrepancy notice will be issued and the same needs to have complied within 30 days from the date of issuance of the notice.
  6. Once the discrepancy has been removed or if there are no discrepancies or objections with the application, the copyright shall be registered, and the Copyright Office shall issue the Extracts of Register of Copyrights (ROC) which is nothing but the Registration Certificate.

On completion of the copyright application, a diary number is sent to the applicant. Registration takes 12 months from this day.

  7. If the application is being filed through an attorney, a specific Power of Attorney in original duly signed by the applicant and accepted by the Attorney
  8. In the case of software, source code, and object code of work for verification.
